Terms of Service & Disclaimer
Version 2026-10-19 · Effective October 19, 2026
1. Who we are and what these terms cover
Bayrabbit Engineering (“Bayrabbit”, “we”, “us”) is based in Washington State, USA. These Terms apply to your use of bayrabbit.com, your customer account, and every tune, unlock and service you buy from us — online or at our shop. By creating an account or buying from us you agree to these Terms and to our Privacy Policy.
2. Your account
- You must be at least 18 years old and able to enter into a binding contract.
- Give us accurate information and keep it up to date. Your email is your login and is not case-sensitive.
- Keep your password secret. You are responsible for everything done through your account. Tell us right away if you think someone else has access.
- We may suspend or close an account that breaks these Terms, is used for fraud, or puts other people, vehicles or our systems at risk.
3. Our services
- Ready Tune — a pre-made engine calibration with conservative settings for a healthy car on the US pump octane you select (91 or 93).
- Custom Tune — a calibration built for your car, the hardware and fuel you declare, refined with your datalogs.
- TCU tune — a transmission calibration, added to an engine tune.
- DME / ECU unlock — makes a locked control unit tunable. Unlocking returns the unit to stock: any tune already on it is erased.
- Tune Care — free log reviews (normally within 24 hours) and free revisions when our checks show a change is needed on the same hardware and fuel.
Power and torque figures on this site are approximate estimates, not a promise. Real results depend on your car's condition, hardware, fuel, climate and altitude.
4. It's a modification — use at your own risk
Tuning changes how your engine and transmission operate. Every tune is a modification of your vehicle's software and custom work. You accept all risk of damage to the engine, transmission, drivetrain or any other part of the vehicle, and of any related cost. Tuning may affect your vehicle manufacturer's warranty.
Our products are intended for off-road and competition use. You are responsible for following all federal, state and local laws that apply to your vehicle, including emissions and inspection laws. We do not sell products or options that remove or disable emissions equipment.
5. Your responsibilities
- Your car is in good mechanical condition before tuning. Fix check-engine lights and known problems first.
- The hardware and fuel you tell us about are accurate, and you use the fuel the tune was made for.
- Datalogs are required with every dongle tune. You record and upload them when we ask, and you follow our flashing and logging instructions.
- You keep a copy of your stock file. We also keep the stock files you upload, but you should not rely on us as your only backup.
- A Custom Tune is built for the hardware and fuel you declared. Any later change (for example a turbo, intake, intercooler, injectors or a different fuel) needs a new revision, which is paid.
6. Files, messages and your content
- Your account lets you send us files (stock files, datalogs, photos) and messages, and receive tune files from us.
- You confirm you have the right to send us the files you upload. You give us permission to store, read, modify and use them to provide our services to you.
- Files are limited to 50 MB each. Don't upload anything illegal, harmful, or that isn't related to your vehicle or request.
- We may keep files and messages for as long as your account is open and as long as needed afterwards for legal, tax and warranty-claim reasons (see the Privacy Policy).
7. License to tune files
Tune files and calibrations we create are licensed to you for use on one vehicle (one VIN) only. You may not resell, share, publish, copy to other vehicles or reverse-engineer them. All rights not expressly granted remain with Bayrabbit.
8. Prices, payment and refunds
- Current prices are shown on the site and confirmed in your request before any work starts. Prices may change; the price confirmed for your request is the one that applies.
- Online payment will be handled by our payment provider (Stripe). We never see or store your full card number.
- Your car can't be flashed (for example, the unit isn't supported or can't be unlocked): we refund the price of the tune.
- Something else is wrong: we review your case and may refund up to the price of the tune. That is the maximum refund in any case.
- DME / ECU unlock: priced per control unit (two units cost twice). For mail-in units you pay shipping both ways. Units that we must send out for unlock are quoted on request.
9. No warranty
To the maximum extent permitted by law, all tunes, unlocks, files and services are provided “as is” and “as available”, without any warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any damage, loss or cost — including engine or transmission damage, repairs, towing, rental cars, lost time or income — arising from the use of our tunes, unlocks, files or services. In any case, our total liability is limited to the price you paid for the tune or service in question.
11. Acceptable use
Don't misuse the site: no attempts to access other customers' data, no malware, no automated scraping, no abuse of our staff. We may remove content and close accounts that do.
12. Emails from us
By creating an account you agree to receive service emails (account confirmation, password resets, messages about your requests and files). Marketing emails are separate and optional — you choose them at sign-up or in your profile and can unsubscribe at any time.
13. Changes to these terms
We may update these Terms. If a change is material, we will tell you by email or in your account before it applies. Continuing to use the site after the change means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be handled by the state or federal courts located in Washington State, unless the law requires otherwise.
15. Contact
Questions about these Terms: use the contact form or the messages in your account. A postal address and phone will be added before launch.
